Welcome to TenderU,
a global social drifting-bottle application designed to help users express emotions, share thoughts, and connect authentically with others.

These Terms of Service ("Terms") form a binding agreement between you ("User")
and TenderU ("we," "us," or "our").
By downloading or using the App, you agree to these Terms. If you do not agree, please discontinue use immediately.


1. Eligibility and Account Requirements

1.1 Age Restriction
TenderU is strictly limited to individuals aged 18 years and older. By using the App, you confirm that you meet this requirement.

1.2 Account Registration
To access certain features, you may be required to register an account and provide accurate, up-to-date information.

1.3 Account Security
You are responsible for maintaining the confidentiality of login credentials. Any activity occurring under your account will be deemed your responsibility.

1.4 False Information Prohibited
Users may not create accounts with falsified identities, misleading details, or impersonate any individual or organization.

1.5 Account Termination Authority
TenderU reserves the right to suspend or terminate accounts that violate these Terms, undermine platform safety, or violate applicable laws.


2. Use of the App

2.1 Personal Use Only
TenderU is intended solely for personal, non-commercial use. Unauthorized commercial use is prohibited.

2.2 Feature Access
Certain features, such as bottle sending/receiving, matching, or messaging, may be restricted based on region, app version, or user activity.

2.3 User Conduct Standards
Users must behave respectfully, avoid harassment, and refrain from harmful, abusive, or illegal interactions.

2.4 System Integrity
You may not attempt to interfere with, disable, circumvent, or exploit any App features, algorithms, or security mechanisms.

2.5 Reports and Feedback
Users may report inappropriate content or technical issues. All reports should be submitted in good faith.


3. Community Rules and Content Restrictions

3.1 Prohibited Content
Users must not upload, create, or distribute content that is illegal, hateful, violent, defamatory, sexually explicit, or harmful to others.

3.2 Zero Tolerance for CSAE
TenderU maintains a strict zero-tolerance policy
toward Child Sexual Abuse and Exploitation (CSAE). Any user engaging in such behavior will face immediate account removal and may be reported to authorities.

3.3 Harassment and Bullying
Threatening, abusive, or discriminatory behavior—whether directly or through drift bottles—is strictly prohibited.

3.4 Respectful Communication
Users must ensure all interactions, including anonymous bottles, remain respectful and safe for others.

3.5 Content Ownership
Users retain ownership of the content they create but grant TenderU a license to use and moderate such content within the App.


4. User-Generated Content (UGC) Guidelines

4.1 Prohibited Content
Users must not upload, create, or distribute content that is illegal, hateful, violent, defamatory, sexually explicit, or harmful to others.

5. Intellectual Property Rights

All trademarks, designs, features, software code, and intellectual property associated with TenderU are owned or licensed by us and protected under international copyright and IP laws.

5.2 Limited License to Users
We grant users a limited, revocable, non-transferable license to access and use the App solely for personal purposes and in accordance with these Terms.

5.3 Restrictions
Users may not copy, modify, distribute, reverse-engineer, decompile, or exploit any portion of the App without explicit written consent from TenderU.

5.4 User Feedback
Any feedback or suggestions you provide may be used by TenderU without compensation or obligation, and you grant us perpetual rights to incorporate such ideas.

5.5 Intellectual Property Violations
Users who infringe third-party intellectual property rights may face account suspension and legal liability.


6. Virtual Items and In-App Features

6.1 Virtual Items Definition
TenderU may offer virtual gifts, bottle-boosting features, or other digital items. These items have no real-world monetary value.

6.2 License to Virtual Items
Users are granted a limited license to use purchased virtual items within the App. Items cannot be transferred, sold, or traded outside the platform.

6.3 Payment Processing
All purchases are processed by authorized payment providers (such as Apple or Google). TenderU does not store payment information.

6.4 No Refund Policy
Unless required by law, all purchases are final and non-refundable.

6.5 Fraud Prevention
Suspicious payment behavior, fraudulent chargebacks, or manipulation of in-app currency may result in account suspension.


7. Safety, Security, and Anti-Abuse Rules

7.1 User Safety Priority
TenderU is committed to fostering a safe social environment. Users must comply with safety rules at all times when interacting with others.

7.2 Content Moderation Authority
We may use automated tools and trained moderators to evaluate drift bottles, messages, images, and other content for policy violations.

7.3 Immediate Enforcement
We reserve the right to suspend or terminate accounts immediately in cases involving harassment, violence, impersonation, hate speech, CSAE, or other severe violations.

7.4 Reporting Mechanisms
Users should promptly report harmful behavior through in-app reporting tools. Reports are kept confidential and reviewed objectively.

7.5 Security Measures
TenderU employs security safeguards to protect the App, but users must also maintain secure devices and avoid sharing account credentials.


8. Data Practices and User Privacy

8.1 Privacy Policy Compliance
Your use of the App is subject to our Privacy Policy,
which explains how data is collected, processed, and protected.

8.2 User Responsibility
Users must review and understand the Privacy Policy. Continued use signifies agreement with data practices outlined in it.

8.3 Disclosure Obligations
TenderU may disclose information when necessary to comply with legal requirements or protect user safety.

8.4 Third-Party Services
Some App features may rely on third-party services governed by their own privacy policies. Users may need to review these independently.

8.5 Data Accuracy
Users must ensure that personal information provided is accurate and current.


9. Account Actions, Suspension & Termination

9.1 Voluntary Account Deletion
Users may delete their accounts at any time via in-app settings. Deleted accounts cannot be restored once removal is finalized.

9.2 Platform-Initiated Suspension
We may suspend accounts for suspicious activity, repeated violations, abusive behavior, or threats to community integrity.

9.3 Permanent Termination
Severe violations—especially CSAE, fraud, impersonation, explicit illegal activity, or harassment—may lead to permanent account termination.

9.4 Notice of Action
TenderU will typically notify users of enforcement actions unless immediate action is required for safety, compliance, or emergency reasons.

9.5 Appeal Rights
Users may appeal suspensions or terminations via service@tenderu.xyz.
Appeals will be reviewed case-by-case but are not guaranteed.


10. Service Availability and Limitations

10.1 No Guarantee of Continuous Access
TenderU aims for reliable service but does not guarantee uninterrupted availability, error-free performance, or permanent operation of all features.

10.2 Maintenance and Updates
The App may undergo scheduled or unscheduled maintenance. Features may be added, modified, limited, or removed without prior notice.

10.3 Compatibility Requirements
Users are responsible for maintaining compatible devices, system versions, and network conditions necessary for proper functionality.

10.4 Regional Restrictions
Certain features may vary or be unavailable in specific countries due to policy, regulatory requirements, or technical constraints.

10.5 Third-Party Failures
TenderU is not responsible for outages or issues caused by third-party providers, internet failures, or platform-level disruptions.


11. Prohibited Activities

11.1 Illegal Use
Users may not use TenderU for any unlawful activities, including fraud, identity theft, human trafficking, or other criminal conduct.

11.2 Exploitation and Abuse
Content or actions that exploit, harm, or harass others—including CSAE, bullying, or targeted threats—are strictly forbidden.

11.3 Spam and Automation
Automated scripts, bots, scraping, or other attempts to manipulate App mechanics, content distribution, or matching systems are prohibited.

11.4 Intellectual Property Violations
Unauthorized reproduction, distribution, or use of third-party intellectual property within TenderU is prohibited and may result in liability.

11.5 Security Breaches
Attempts to access, interfere with, or compromise TenderU’s systems, servers, or other users’ accounts are strictly prohibited.


12. Intellectual Property of User Content

12.1 Ownership
Users retain ownership of their content but grant TenderU a license to operate, display, and moderate the content within the App.

12.2 Rights Granted
The license granted to TenderU is non-exclusive, worldwide, royalty-free, sublicensable, and revocable
only through account deletion or content removal.

12.3 Content Review
TenderU may review, restrict, or remove content violating Terms, local laws, or community standards.

12.4 User Responsibility
Users are solely responsible for ensuring their content does not infringe on third-party rights or contain prohibited material.

12.5 Content Reporting
Users may report content violations. TenderU will review reports promptly and take necessary action.


13. Virtual Goods, Payments, and Refunds

13.1 Virtual Items
Virtual gifts or in-app items are for personal use within TenderU and cannot be redeemed for cash or transferred outside the App.

13.2 Payment Handling
All transactions are securely processed through certified third-party payment providers (e.g., Apple App Store, Google Play).

13.3 Non-Refundable Policy
Purchases are generally non-refundable unless legally required. Users must carefully review purchases before confirming.

13.4 Suspicious Transactions

Termination revokes access to all App features, content, and virtual items. User data may be retained for legal or operational purposes.

Legitimate users may request account recovery after verification, provided the account was not terminated for serious policy violations.

18.1 No Guarantee of Continuous Access
TenderU does not guarantee uninterrupted service. Technical failures, maintenance, or third-party issues may cause temporary disruptions.

18.2 Feature Changes
We reserve the right to modify, add, or remove App features at any time without prior notice.

18.3 User Responsibility
Users are responsible for maintaining compatible devices, stable internet connections, and up-to-date system versions.

18.4 Third-Party Dependencies
TenderU is not liable for failures caused by external services, servers, or platforms necessary for App operation.


19. Liability Limitations

19.1 No Warranty
TenderU is provided “as-is”
and “as available”
without warranties of any kind.

19.2 Indirect or Consequential Damages
TenderU shall not be liable for indirect, incidental, or consequential damages, including loss of data, emotional distress, or missed opportunities.

19.3 User Responsibility
Users acknowledge that all interactions, messaging, or content exchanges occur at their own risk.

19.4 Jurisdictional Exceptions
Where applicable law prohibits limitation of liability, restrictions apply only to the extent permitted by law.


20. Indemnification

Users agree to indemnify, defend, and hold harmless TenderU, its affiliates, officers, and employees against any claims, liabilities, damages, or costs arising from user content, violations of these Terms, or infringement of third-party rights.
